Canadian ePrescribing Message Specifications Infoway Open Licence 1.0 (Iol 1.0 Licence)

Permission is hereby granted, free of charge (except as otherwise provided), to any person obtaining a copy of the Canadian ePrescribing Message Specifications (the “Material”), to deal in the Material, including, without limitation, the rights to make, have made, use, copy, publish, distribute, make available, perform, adapt, make derivative works, sublicence, and/or sell copies of the Material, to incorporate the Material in products, services, devices, software, systems, models, or other technological developments, and to permit persons to whom the Material is furnished to do so, subject to the following conditions:

The above copyright notice and these licensing terms shall be included in all copies or substantial portions of the Material.

You are not authorized to modify the Material in the context of its implementation in a manner that would prevent the interoperability of the product, service, device, software, system, model, or other technological developments that incorporates the Material with other products, services, devices, software, systems, models, or other technological developments incorporating the Material in the Canadian healthcare system. If you wish for modifications to be made to the Material, you are encouraged to participate in the working groups of Canada Health Infoway in order to advocate for such modifications.

If you wish to include features that are not part of the Material by adding such new features to a product, service, device, software, system, model, or other technological developments that incorporates the Material, this shall be permitted only to the extent that these additional features do not prevent interoperability with other products, services, devices, software, systems, models, or other technological developments incorporating the Material in the Canadian healthcare system. In the event that certain features are reasonably identified as preventing interoperability, you shall not use these additional features in an implementation of the Material.

Implementation of the Material may require a licence from certain owners of certain patents, certificates of supplemental patent protection, industrial designs, utility models, patent applications, industrial design applications and utility model applicants. Such licences may require the payment of royalties or other consideration. Please consult Canada Health Infoway’s website for additional information. Canada Health Infoway only lists rights that have been declared to it pursuant to its applicable Open Innovation and Standard Setting (OISS) Policy, it may not be an exhaustive list of applicable rights.

The grant of this licence does not allow the use of any trademarks and service marks of Canada Health Infoway in association with products, services, devices, software, systems, models, or other technological developments, except to the extent a separate licence agreement is entered into.

THE MATERIAL IS PROVIDED “AS IS, WHERE IS” BASIS WITHOUT ANY REPRESENTATION, WARRANTY OR CONDITION OF ANY KIND BY CANADA HEALTH INFOWAY, WHETHER EXPRESS, IMPLIED OR PROVIDED BY ANY APPLICABLE LAW, INCLUDING WITHOUT LIMITATION ANY REPRESENTATION, WARRANTY OR CONDITION OF FITNESS FOR PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT OR NON-VIOLATION OF THIRD PARTY RIGHTS. IN NO EVENT SHALL CANADA HEALTH INFOWAY NOR ANY CONTRIBUTORS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE MATERIAL OR THE USE, IMPLEMENTATION OR OTHER DEALINGS IN THE MATERIAL.

This IOL 1.0 License shall be governed by the domestic laws applicable in the province of Ontario, including federal laws, without regard to conflict of law principles.
